The Short Version
If you only read one part, read this. The full terms below are what legally applies.
- EzyFund is free to use. You never pay us to apply.
- With your consent, we send your application to a credit provider registered with the National Credit Regulator.
- The lender decides whether to lend, sets the terms, and the credit agreement is between you and the lender.
- Calculator figures are the legal maximums. The written quote from your lender is what counts.
- You must give true, complete and up-to-date information about yourself.
1About These Terms
These terms apply to your use of www.ezyfund.co.za (the “website”) and the loan services we offer through it (the “service”). In these terms, “EzyFund”, “we”, “us” and “our” refer to the operator of the website, and “you” refers to anyone who uses it.
By using the website or submitting an application, you agree to these terms and to our Privacy Policy. If you don’t agree, please don’t use the service.
These terms are an agreement concluded electronically under the Electronic Communications and Transactions Act 25 of 2002. Nothing in them takes away any right you have under the Consumer Protection Act 68 of 2008, the National Credit Act 34 of 2005 or any other law.
2What EzyFund Does
EzyFund is a free online loan service provider. When you apply through the website, we pass your application to a credit provider registered with the National Credit Regulator (NCR) so that they can assess it.
- The lender carries out the credit check and the affordability assessment required by the National Credit Act.
- The lender decides whether to offer you credit, and on what terms.
- If you accept an offer, the credit agreement is between you and the lender, and the lender’s own terms apply to it.
- We do not guarantee that you will be approved, or that you will be offered a particular amount, term or cost.
We do not charge you anything for using the service. We may receive a fee from a lender when we introduce you to them. This does not change your right to receive a written quotation from the lender showing the full cost of any credit before you sign.
3Who Can Use The Service
To apply through EzyFund you must:
- be 18 years or older and legally able to enter into a contract;
- have a valid South African identity document;
- apply in your own name, using your own personal and banking details.
Please don’t apply if you are under debt review, sequestration or administration. The National Credit Act restricts new credit in these situations, and applying may make your circumstances harder to manage.
4Your Application And Information
When you apply, you confirm that the information you give us is true, complete and up to date. Lenders rely on it to assess your application, and giving false information may be a criminal offence.
By submitting an application, you consent to us:
- sharing your application with a registered lender so that they can assess it;
- the lender verifying your identity, income and banking details and checking your credit record with a credit bureau;
- the lender contacting you about your application by phone, SMS or email.
We may decline to send an application that appears incomplete, inaccurate or fraudulent.
5Costs And The Loan Calculator
Using EzyFund is free. If you take a loan, the lender may charge interest, an initiation fee and a monthly service fee, each capped by the National Credit Act and its regulations. VAT is added to the fees.
Our loans calculator shows estimates based on the maximum charges the law allows for short-term credit. The figures are for illustration only. Your actual cost is set out in the pre-agreement statement and quotation the lender must give you before you sign, and the lender may charge less than the maximum.
6No Financial Advice
The information on the website is general information to help you understand short-term loans. It is not financial advice and does not take your personal circumstances into account.
Only borrow what you can comfortably repay. If you are struggling with debt, free help is available from the National Credit Regulator on 0860 627 627, who can refer you to a registered debt counsellor.
7Lenders And Other Websites
Lenders are independent businesses. Their products, decisions, fees, collections and customer service are their responsibility, and their own terms and privacy policies apply to you once your application reaches them.
The website may link to other websites, such as the NCR. We don’t control those websites and aren’t responsible for their content.
8Privacy And Cookies
We process your personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA). Our Privacy Policy explains what we collect, why we collect it, who we share it with and your rights.
We use essential cookies to run the website. With your consent, we also use analytics cookies. You can change your choice at any time using the Cookie settings link in the footer.
9Using The Website Properly
When you use the website, you agree not to:
- apply on behalf of someone else or use anyone else’s details;
- submit false, misleading or fraudulent information;
- try to gain unauthorised access to the website, our systems or other people’s data;
- use bots, scrapers or other automated tools to collect content or submit applications;
- upload anything harmful, such as viruses or malicious code.
We may block access to the website for anyone who breaks these rules.
10Our Content
The EzyFund name, logo, website design, text and graphics belong to EzyFund or are used with permission. You may view and print pages for your own personal use, but you may not copy, sell or republish our content without our written consent.
11Our Responsibility To You
We work hard to keep the website accurate and available, but it is provided “as is”. It may sometimes be unavailable, and information on it may change.
As far as the law allows, we are not responsible for:
- a lender’s decision to approve or decline your application, or the terms they offer;
- anything a lender does or fails to do under your credit agreement with them;
- loss caused by information you gave us that was incorrect or incomplete;
- loss caused by events outside our reasonable control.
Nothing in these terms limits our responsibility where the law does not allow it to be limited, including for gross negligence, or any right you have under the Consumer Protection Act or the National Credit Act.
12Changes To The Service And These Terms
We may update the service and these terms from time to time, for example when the law changes. The date at the top of this page shows when the terms were last updated. The terms in place when you submit an application apply to that application.
13Questions And Complaints
If you have a question or complaint about the website or our service, please contact us and we will do our best to resolve it.
Complaints about a loan, a lender’s fees or how a lender treated you should go to the lender first. If the lender does not resolve it, you can contact the National Credit Regulator at complaints@ncr.org.za or on 0860 627 627.
14Governing Law
These terms are governed by the laws of the Republic of South Africa, and South African courts have jurisdiction over any dispute about them.
If any part of these terms is found to be invalid, the rest of the terms still apply.
